Our question to Barry is….Did he know that Mr. Stone was represented by an attorney when he made him sign a document which prevented him from talking to own lawyer?
Well….then….Mr. McHugh…you got some troubles….there’s this little provision in the Idaho Rules of Professional Conduct which says:
RULE 4.2: COMMUNICATION WITH PERSON REPRESENTED BY COUNSEL
In representing a client, a lawyer shall not communicate about the subject of the representation with a person the lawyer knows to be represented by another lawyer in the matter, unless the lawyer has the consent of the other lawyer or is authorized to do so by law or a court order.
We don’t care what issue with Mr. Stone was. It is simply not proper for a Prosecuting Attorney to violate State Bar Rules and deny someone their Constitutional Right to counsel and marital communication! (He couldn’t even talk to his wife???? Are you kidding us!!!!)
Surely this violates more lawyer rules?????? Just wondering!
Well, we feel funny doing this again, but Kudos to the Coeur d’Alene Press for another good story. Maybe there is some journalism going on down there after all!
