News Flash:
The following message appeared on Jeff Ward’s Facebook page today…
Attention Reagan Republicans: A fraudulent flyer using KCRRs name and proprietary branding and common law trademarks hit mail boxes today in Kootenai County. None of the people endorsed in the piece are actually endorsed by Reagan Republicans. It is plain and simple statutory fraud. Fraud conducted via U.S. Mail is mail fraud, a federal felony. KCRR will pursue prosecution to the fullest extent of the law and will be filing requests for investigations with the U.S. Attorney, the United States Postal Inspection Service, the Idaho Attorney General, Kootenai County Sheriff and Prosecuting Attorney. Voter fraud and mail fraud are serious crimes and these criminals victimizing the voters of Kootenai County should be brought to swift and decisive justice. One would hope the candidates endorsed by this spurious mailer have enough character to publicly repudiate it and the criminals who sent it.
Then this reply was emailed to us by The Kootenai County Reagan Republicans, Inc. / Idaho Reagan Republicans PAC (they said they posted it on Wards FB page, but we couldn’t find it)…
Dear Mr. Ward,
I am the Chairman of the Idaho Reagan Republicans PAC. We are the PAC for the Kootenai County Reagan Republicans, Inc. As you should be aware, we are a duly organized Idaho, Non-Profit Corporation, and we are in good standing with the Idaho Secretary of State.
It has been brought to our attention that you have made, publicly certain false and defamatory statements about us (our PAC and Corporation), including accusing us of committing Voter Fraud, Mail Fraud, “Plain and simple statutory fraud” (what ever that might be) and fraudulently using Kootenai County Reagan Republicans name and “proprietary branding and common law trademarks”.
Your statements are provably false and defamatory. As you should be aware, Defamation is a criminal offense and a viable civil cause of action in the State of Idaho. Furthermore, since you have accused us of criminal conduct, the defamation is “per se” and you must prove the allegations are true to defend yourself.
A few items for your consideration: (1) We are authorized by the State of Idaho to conduct business under the name “Kootenai County Reagan Republicans”. (2) We did, in fact, endorse the candidates listed on the flyer, which you intentionally and incorrectly describe as “fraudulent”. (3) There is not a single element on the mailer that constitutes your “proprietary branding” or trademark able element. (4) We are aware that you attempted to trademark our name, but that you were in-fact, denied trademark protection by the United States Patent and Trademark Office.
This letter is our one and only warning to you. You must immediately retract your defamatory statements wherever published.
If you fail to do so we will pursue every legal means to protect our name and reputation and to recover all damages possible for tortuous conduct.
